The use of the website of Berliner Wasserbetriebe including the offered online services and the direct internet offers is subject to the following terms of use.

1. User

The user of the offered online services is the customer of Berliner Wasserbetriebe as well as the persons authorised by him.

2. Technical requirements

To use the online services, the online user requires Internet or a proprietary online service with internet access. The online services are transferred only with an SSL encryption. Berliner Wasserbetriebe offers a key length of 256 bit for a high security. But the function is also usable with a lower key length. However, Berliner Wasserbetriebe does not assume any guarantee, warranty or liability for accuracy, completeness, timeliness, quality and usability of the information and content.

Berliner Wasserbetriebe also does not assume any liability for constant and uninterrupted accessibility and usability of the website including the offered online services. This limitation of liability is not valid in case of fatality or  bodily harm or health issues caused by Berliner Wasserbetriebe, its legal representatives or its vicarious agents. Apart from that, in case of fatality or  bodily harm or health issues, the liability is additionally limited to damages typical for this type of contract and to the foreseeable damages at the time of the conclusion of the contract.

In case of gross negligence, the liability is limited to the amount of EUR 10,000 per claim. A liability of Berliner Wasserbetriebe for damages caused due to misuse of password is excluded.

Berliner Wasserbetriebe is not liable for damages caused by incorrect inputs for the online services of Berliner Wasserbetriebe. The Berliner Wasserbetriebe is not liable for the usability of the services of internet or service providers.

8. Blocking

Access to the online services of Berliner Wasserbetriebe will be blocked if the user has initiated the block himself. Apart from that, Berliner Wasserbetriebe is authorised to block access to the online services at all times if this is required for an orderly contract processing, if the user violates the terms of use or if blocking is necessary due to any other reason.

13. Severability clause

If individual stipulations of these terms of use are or become completely or partially ineffective, the legal validity of the remainder stipulations shall not be affected by it. The ineffective stipulation will be replaced by an effective stipulation, which – if legally permissible –comes as close as possible to the purpose or objective of the ineffective stipulation.

14. Applicable law

All the information or data and its use are subject to the German law. The place of fulfilment and the exclusive court of jurisdiction for the obligations resulting from the use of the website of Berliner Wasserbetriebe is the district court of Mitte or Regional court of Berlin, provided the user is a businessman, a legal person under public law or a separate estate of public law.
